The Website is operated by On The Coast Real Estate, LLC (“On The Coast Real Estate,” “we,” “us,” or “our”), a South Carolina real estate brokerage.
By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website.
You must be at least 18 years old and able to enter into a binding agreement to create an account or use features that require acceptance of these Terms. If you use the Website for another person or an organization, you represent that you are authorized to act on their behalf.
The Website provides general real estate information, property-search tools, and ways to contact our brokerage. Website content is not a substitute for professional advice or an independent review of a property, transaction, contract, financing option, tax issue, insurance matter, or legal obligation.
Visiting the Website, creating an account, saving a property, requesting information, or communicating with us does not by itself create a client, agency, fiduciary, or brokerage relationship. Unless and until the required written brokerage agreement, disclosure, or consent is completed, you may be treated as a customer rather than a client as provided by South Carolina law.
Any brokerage relationship and the duties associated with it will be governed by the applicable written agreement and required disclosures, not solely by these Terms or your use of the Website.
Property information may be supplied by third-party Multiple Listing Services (MLS), Internet Data Exchange (IDX) systems, listing brokers, public records, sellers, or other sources. Information is deemed reliable but is not guaranteed. Listings, prices, availability, status, square footage, acreage, room counts, schools, zoning, flood information, insurance availability or cost, taxes, assessments, fees, restrictions, and other details may change, be delayed, or contain errors.
You should independently verify all material information before making a decision or entering into a transaction. Website listings and other property information are not an offer, commitment, appraisal, inspection, or guarantee that a property is available or suitable for your needs.
Property-search data is provided for your personal, non-commercial use. You may not scrape, harvest, bulk-download, reproduce, republish, sell, or commercially exploit MLS, IDX, listing, or Website data except with prior written authorization from the applicable rights holder.
You agree to provide accurate, current information and to keep your login credentials secure. You are responsible for activity under your account and should notify us promptly if you believe your account or credentials have been compromised.
Saved searches, favorites, listing alerts, and similar features are provided for convenience. Alerts may be delayed, incomplete, or affected by changes in third-party data. Contact a licensed real estate professional to confirm current listing status and material property details.
We may restrict, suspend, or terminate an account or feature when reasonably necessary to address security concerns, unlawful activity, misuse, interference with the Website, or a violation of these Terms.
If you submit an inquiry or request information, you authorize us to respond using the contact information you provide. Responses that you request, account notices, showing coordination, and transaction-related communications are not conditioned on separate marketing consent.
Marketing consent is optional. Creating an account, submitting an inquiry, or purchasing property, goods, or services does not require you to agree to marketing emails or text messages. Where offered, email and text-message choices are presented separately.
Email. If you select the email option, you agree to receive property updates and marketing emails from On The Coast Real Estate. You may unsubscribe through the link in an email or by contacting us below. You may still receive non-promotional communications that you request or that concern your account or an ongoing transaction.
Text messages. If you select the text-message option and submit the form, you provide your prior express written consent to receive recurring automated property updates and marketing text messages from or on behalf of On The Coast Real Estate at the mobile number you provide. Consent is not a condition of purchasing property, goods, or services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. You may also revoke consent through any reasonable method, including contacting us below. We may send one non-marketing message confirming an opt-out request.
You represent that you are the subscriber or customary user of any mobile number you provide and will notify us if that number changes. Carriers are not liable for delayed or undelivered messages. Our collection and use of contact information and consent records are described in our Privacy Policy.

MLS, IDX, listing, map, and other third-party content may be subject to separate ownership, license terms, and use restrictions.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Website for personal, lawful real estate research and communication. No ownership rights are transferred to you.
You are responsible for the accuracy and lawfulness of information you submit. You represent that you have the right to provide it and that doing so does not violate another person’s rights. Do not submit highly sensitive information through a general inquiry form unless we specifically request it through an appropriate method.
We handle personal information as described in our Privacy Policy. General feedback or suggestions about the Website may be used to improve our services without an obligation to compensate you.
The Website may rely on or link to third-party services, including MLS and IDX providers, maps, analytics, social-media platforms, lenders, inspectors, attorneys, title companies, insurance providers, and other real estate resources. We do not control and are not responsible for third-party content, availability, terms, privacy practices, products, or services. A link or integration does not necessarily mean we endorse or guarantee the third party.

Unless expressly stated in a separate written engagement, Website content and communications are not legal, tax, accounting, investment, appraisal, inspection, engineering, insurance, lending, or other specialized professional advice. Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.
To the fullest extent permitted by law, On The Coast Real Estate and its owners, brokers, agents, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost data, loss of use, or business interruption arising from or related to the Website, third-party services, property information, or these Terms.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded. Your rights may vary depending on applicable law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless On The Coast Real Estate and its owners, brokers, agents, employees, contractors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Website, your violation of these Terms, or your infringement of another person’s rights.
You may stop using the Website at any time. We may suspend, limit, or discontinue all or part of the Website, or terminate access, when reasonably necessary for maintenance, security, legal compliance, third-party service changes, misuse, or a violation of these Terms. Provisions that by their nature should survive termination will remain in effect.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Subject to any non-waivable legal right, any court proceeding arising from these Terms or the Website will be brought in a state or federal court with jurisdiction in Charleston County, South Carolina, and you consent to that venue.
